Terms of Use
These Terms of Use govern your access to and use of Cardulate. Please read them carefully.
Last updated October 19, 2026
These Terms of Use (the “Terms”) are an agreement between you and Benchmarke LLC, an Indiana limited liability company (“Benchmarke,” “we,” “us,” or “our”), which operates the Cardulate website at cardulate.app and its related services (the “Services”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. The Services
Cardulate is a trading card catalog and collection tracker. Anyone may browse the card catalog for free. With an account, you can also track your collection, keep a wishlist, and share links to cards. The Services are currently offered as a beta, and features may change as we develop them.
2. Eligibility and accounts
You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian.
You are responsible for the activity on your account and for keeping your sign-in details secure. Please tell us promptly at support@benchmarke.io if you believe your account has been accessed without your permission.
3. Acceptable use
You agree not to:
- Access or attempt to access another user's account or private information.
- Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Services or the systems that run them.
- Scrape, crawl, copy, or harvest the Services or their content by automated means, except as permitted by a public search engine's standard indexing.
- Resell, redistribute, or republish catalog or price data from the Services as a dataset, feed, or competing service.
- Remove or alter any attribution, copyright, or proprietary notice.
- Use the Services for any unlawful, fraudulent, abusive, or infringing purpose, or to misrepresent your affiliation with any person or company.
4. Your content
You keep ownership of the information you add to the Services, such as your collection records and notes (“Your Content”). You grant Benchmarke a non-exclusive, worldwide, royalty-free license to store, process, and display Your Content to provide the Services to you. Your collection and wishlist are private to your account, and we do not make them public.
You also grant Benchmarke a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use Your Content to create aggregated, de-identified information that does not identify you, such as card prices paid and sold across many users. Benchmarke owns that aggregated, de-identified information and may use, publish, share, sell, and license it, including through paid data products or an API, without payment or attribution to you. Our Privacy Policy explains how we de-identify it. This license survives the deletion of your account for information already aggregated.
5. Prices and catalog information
Card details, images, and market prices shown in the Services come from third-party sources. Prices are provided for general reference only. They are shown with their source and date, may be out of date or inaccurate, and are not an appraisal, offer, or guarantee of what a card is worth or will sell for. Nothing in the Services is financial, investment, tax, or legal advice. You are solely responsible for any buying, selling, or trading decisions you make.
If you choose a currency other than US dollars, prices are converted for display using the euro foreign exchange reference rates published by the European Central Bank (source: ECB statistics), recalculated against the US dollar and updated once each business day. Converted prices are approximate, for information only, and are not a quote from any marketplace or bank.
6. Free access and paid features
Browsing the card catalog is free and will remain free. We may in the future offer optional paid features, such as access to prices for every card. Any paid feature will be described, along with its price, billing, and cancellation terms, before you are asked to pay.
7. Intellectual property
The Services, including the Cardulate name, logo, design, software, and original content, are owned by Benchmarke and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-transferable license to use the Services for your own non-commercial purposes.
Card names, images, artwork, and game marks belong to their respective owners. Cardulate is not produced by, endorsed by, sponsored by, or affiliated with any card game publisher, including The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK Inc., Wizards of the Coast LLC, Pocketpair, Inc., or Bushiroad Inc.
Cardulate is unofficial Fan Content permitted under the Wizards of the Coast Fan Content Policy. Not approved/endorsed by Wizards. Portions of the materials used are property of Wizards of the Coast. ©Wizards of the Coast LLC.
If you believe content on the Services infringes your rights, contact us at support@benchmarke.io with a description of the material and your relationship to it, and we will review it promptly.
8. Third-party services
The Services rely on third-party providers and may link to third-party websites. We are not responsible for third-party services, websites, or content, and your use of them is subject to their own terms.
9. Suspension and termination
You may stop using the Services at any time and may ask us to delete your account. We may suspend or terminate your access if you violate these Terms, if your use creates risk or legal exposure for us or others, or if we discontinue the Services. Sections 4 through 7 and 10 through 13 survive termination.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CATALOG OR PRICE INFORMATION IS ACCURATE OR CURRENT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BENCHMARKE AND ITS MEMBERS, MANAGERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
12. Indemnity
You agree to indemnify and hold harmless Benchmarke from any claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Services or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Indiana, and you consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and if the changes are significant, we will provide additional notice within the Services. Your continued use of the Services after an update means you accept the revised Terms.
15. General
These Terms and our Privacy Policy are the entire agreement between you and Benchmarke about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
